A hot-tub session turned violent Monday when one man threatened another with a shotgun, Gainesville police said.

It was about midnight at the Ridge Apartments, located at 3718 SW 24th Ave., when 18-year-old Cristian Gutierrez, of Gainesville, walked passed the hot tub toward the apartment’s gym, according to a police report.

A man in the steaming-warm water with friends then asked Gutierrez for a cigarette. He said he didn’t smoke — and then retrieved the shotgun from his car’s trunk and pointed it at the man, according to the report.

Gutierrez told police he had a shotgun shell in his hand, but he threw it into the tub.

He said he was having a bad day, according to the report.

After his arrest, Gutierrez told police the man in the hot tub, who he said was drunk, called him a “b----” and threatened to fight him after Gutierrez told him he didn’t smoke, according to the report.

He told police the man taunted him, prompting him to retrieve his gun from his car, according to the report.

Gutierrez said he didn’t intend on shooting anyone, according to the report. After the incident, he got into his car and drove away.

Police arrested Gutierrez on a charge of aggravated assault. Authorities took him to Alachua County Jail on Monday, where he remains in lieu of a $15,000 bond.

As of press time, Gutierrez could not be reached for comment.
